A legal challenge will go ahead into mine expansion plans after opponents were granted a judicial review, reports BBC News.
In January approval was given for another 40 million tonnes of coal to be dug at Aberpergwm, Neath Port Talbot.
Campaigners said at the time they were considering legal action.
The Welsh government, which declined to comment citing the legal proceedings, has previously called for an overhaul of the Coal Authority following the dispute over the plans.
Protest group Coal Action Network has said it was preparing to go to court.
It tweeted: “We don’t know how to give up because there is everything to fight for.”
The colliery is the only producer of high-grade anthracite in Western Europe and supplies nearby Tata Steel plant in Port Talbot.
However, the mine’s operator Energybuild has said most of the coal will be used for processes such as water filtration and to make batteries for electric vehicles, rather than being burned.
The legal action has been backed by the Welsh Liberal Democrats.

Renewables, batteries and electricity transmission are all dependent on large scale mining. Then steel making relies mainly on coal for its furnaces. Blinkered protesters can’t hide from this.

It takes energy to mine and process the materials and to manufacture the wind and solar to replace our coal mines, it has been outsourced to China. Trying to do stuff at home, after giving it all away, is going to be difficult, the mindsets that destroyed western energy are still in powerful positions.

All they’re fighting for is for China to do the same work with the same energy use, then ship the output to the UK.
would this be a paradigm of paradoxes, or a paradigm shift? ….’taking “fossilfuel” to mine and process materials for manufacturing ‘green’ energy producing machines’ ? Huh, about as daft as growing ( ANY ) foodstuffs to produce fuel. what is more important : food or fuel ? Lest everybody forget, we burnt hydrocarbons to replace horses and release the area required to feed them, to produce OUR food and lift us out of drudgery. To produce an energy storage system ( RESERVOIR ) a much cheaper version is the metal or plastic fuel tank, compared with the battery.. .. We need a reliable SOURCE of enrgy, not a reliable STORAGE for Energy. FFS. one can store oil in any non-leaking container, coal in any box or bag, ( or a heap on the ground – even in the rain ), but electricity ? I dare you!
We all want a good life. But the more our Governments try and divide society with those who can and cant have a decent job, afford a house, petrol, food, etc., the more chance there is of a civil war and or poorer people siding with those who do not subscribe to the elitists agenda. Also factor in that more young people will commit suicide because of the depression this is causing. You cant hide or turn your back on this appalling situation.
